Terms of service

Clear terms for using our website, free guides, templates and other public resources.

Last updated: 18 September 2026 · Website and free resources

1. About these terms2. Using the website responsibly3. Guides, templates and educational material4. Intellectual property and third-party material5. Product information and comparisons6. Enquiries and downloads7. Website availability and external links8. Responsibility and liability9. Changes and interpretation10. Governing law and contacting us

1. About these terms

These terms govern use of www.new-dynamics.com, its public content, interactive previews and downloadable resources. The website is operated by New Dynamics LTD, based at:

New Dynamics LTD
1 Clifton Down Road
Bristol, BS8 4AL
United Kingdom

Contact us at contact@new-dynamics.com. Please read these terms before using the website or downloading our resources, and keep a copy if you need one for reference.

The website provides information about New Dynamics and an opportunity to request a conversation. It does not offer an online checkout or, by itself, create a subscription to our software. Paid software, implementation and other services require a separate written agreement specifying their scope and commercial terms. These website terms do not replace that agreement or an applicable data processing agreement.

2. Using the website responsibly

You may use the website to learn about our services, evaluate performance management approaches, use the permitted resources and make genuine business enquiries. You are responsible for ensuring that information you submit is accurate to the best of your knowledge and that you are entitled to share it.

You must not use the website to:

  • Break applicable law, infringe another person’s rights or submit unlawful, threatening, deceptive or harmful content.
  • Upload malicious code, interfere with the website, overload its systems or attempt unauthorised access.
  • Probe, bypass or disable access controls, download gates or security measures without our written authorisation.
  • Send spam, impersonate another person, misrepresent an affiliation or submit someone else’s personal information without an appropriate basis.
  • Systematically extract content or data in a way that infringes rights, disrupts the service or circumvents technical restrictions.

Ordinary search-engine indexing of publicly indexable pages is permitted subject to the website’s published crawling rules. This does not grant a licence to republish our content or access restricted resources.

3. Guides, templates and educational material

Unless a particular resource states otherwise, New Dynamics grants you a non-exclusive permission to download, copy and adapt our free guides and templates for your own internal business use. You may share them with colleagues within your organisation for that purpose. Keep relevant copyright and source notices on copies.

You may not sell the resources, publish them as your own, redistribute them as a competing public resource library or imply that New Dynamics has endorsed your organisation or a modified version. Contact us if you want permission for broader distribution or another use. This permission does not restrict uses that applicable law allows independently.

Our guides, comparison material and templates provide general information. They are not legal, tax, employment or other regulated professional advice, and are not tailored to every organisation or jurisdiction. Consider your own policies, people and circumstances, and obtain appropriate professional advice where needed before making a consequential decision.

A resource’s examples and suggested processes are starting points for evaluation. Downloading or following a guide does not guarantee a particular business, employee or compliance outcome.

4. Intellectual property and third-party material

New Dynamics or its licensors own the rights in the website’s original text, design, software and other material, except where another owner or licence is identified. No ownership is transferred by visiting the website or downloading a resource.

Third-party product names, logos and trademarks belong to their respective owners. They appear to identify products being discussed or compared and do not imply endorsement, partnership or affiliation. A comparison listing is not a claim that New Dynamics supplies or supports that vendor’s product.

Some material carries its own licence. For example, the credited Bristol photograph on our About Us page is available under its stated Creative Commons licence. That licence applies to the photograph; it does not place the entire website under the same licence. Where third-party licence terms apply, follow those terms for the relevant material.

5. Product information and comparisons

We aim to make our content useful and accurate, but software features, packaging, integrations and commercial terms change. Comparison pages explain their editorial approach and review date. They present New Dynamics’ analysis of vendor-published material and are not a substitute for checking the current product, plan and contract with each supplier.

Interactive previews illustrate workflows. They are not your organisation’s live workspace and should not be used to store real employee information. A visual example does not establish every available configuration, integration, security control or commercial entitlement.

Confirm the capabilities, implementation responsibilities, support arrangements, pricing and other requirements relevant to your purchase in a written proposal and agreement. A demo request or guide download does not create a purchase commitment.

If you identify a factual error, broken resource or outdated comparison, email contact@new-dynamics.com with the page and relevant details so we can investigate.

6. Enquiries and downloads

Some downloads require a short form. Required fields allow us to record your request and supply the resource; optional questions let you share relevant context. Our privacy notice explains what is collected, how it is used and the choices available to you.

When the form confirms that an enquiry is saved, it means the request has been recorded. It does not confirm an appointment, a support response time, a service order or acceptance of proposed contractual terms. The team will use the details you provide to respond to the relevant request.

Please avoid confidential employee information in enquiries. If more detailed information is needed, agree a suitable way to exchange it with us first. If a form fails, follow the on-screen instructions or contact contact@new-dynamics.com; do not assume a request has been received without confirmation.

7. Website availability and external links

We may update, maintain, change or withdraw website content and free resources. We do not guarantee uninterrupted access or that every page and resource will always be available. Where appropriate, keep your own permitted copies of resources you need.

We may restrict use that breaches these terms or creates a security or operational risk. Any action will be considered in light of the circumstances and applicable law. These website terms do not give us a right to change separately agreed paid service commitments.

Links to external websites are provided for context and convenience. We do not control those websites, their security, their terms or their privacy practices. Check the relevant supplier’s own information before relying on it or providing personal data.

8. Responsibility and liability

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited. Nothing removes mandatory rights you have under applicable consumer or other law.

Subject to that paragraph and to the extent permitted by law, we do not give a warranty that the free website or general resources will meet your particular requirements, be uninterrupted or be free from every error. We are not responsible for losses caused by decisions based solely on general material where the relevant circumstances, current supplier information or appropriate advice should first have been checked.

If you use the website for business purposes, to the extent permitted by law we are not liable under these website terms for loss of profits, revenue, business opportunity or anticipated savings, or for indirect or consequential loss arising from use of the free website or its resources. These exclusions apply only where lawful and reasonable in the circumstances.

If you are a consumer, you retain all applicable statutory protections. We remain responsible for loss that the law requires us to bear. Liability for paid software or services is addressed in the relevant separate agreement, subject to applicable law.

9. Changes and interpretation

We may revise these terms to reflect changes in the website, resources or legal requirements. The updated version and date will appear here. Changes apply to future use and do not retrospectively remove rights you have already acquired or change a separate signed agreement.

If a provision is found unenforceable, the remaining provisions continue to apply to the extent permitted by law. A delay in exercising a right does not by itself waive that right. These terms do not create a partnership, agency or employment relationship between you and New Dynamics.

10. Governing law and contacting us

These website terms are governed by the laws of England and Wales. For business users, the courts of England and Wales have exclusive jurisdiction over disputes arising from these website terms.

If you are a consumer, this does not deprive you of mandatory protections or rights to bring proceedings in the courts available to you under applicable law.

For a question, complaint or permission request, contact contact@new-dynamics.com. Please identify the relevant page or resource and explain the issue so we can address it.
