Tax on long-service awards: UK and US basics

This is general information, not tax advice. Rules and limits change, so check the current guidance, or ask your payroll provider.

United Kingdom

GOV.UK's guidance on long-service awards says that an employer does not have to report or pay tax on a non-cash award if all of the following apply: the employee has worked for the employer for at least 20 years, the award is worth less than £50 per year of service, and they have not received a long-service award in the last 10 years. It gives an example: “you can give a non-cash award with a value of up to £1,000 for 20 years' service.”

Two points follow. The exemption starts at 20 years, which makes this anniversary a natural moment for a substantial gift. And it covers non-cash awards. Cash, and awards under salary sacrifice arrangements, are treated differently.

United States

The Internal Revenue Service's Publication 15-B covers employee achievement awards. An award can be excluded from wages if it is tangible personal property “given to an employee for length of service or safety achievement”, is “awarded as part of a meaningful presentation”, and is not disguised pay. The publication lists the exclusion as up to $1,600 for qualified plan awards, and $400 for nonqualified awards. It states that the exclusion does not apply to cash, gift cards, vacations, meals, lodging, tickets to theatre or sporting events, or securities.

So in both countries, the tax treatment depends on what you give. Check before you buy.

Mistakes to avoid

Forgetting. Nothing says “you are taken for granted” like a missed twentieth anniversary.
